Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.
These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Purchases

If you wish to purchase any product or service made available through the Service (), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

The Service and its original content, features and functionality are and will remain the exclusive property of Valetec Co. and its licensors. The application is protected by copyright, trademark, and other laws of both the Kuwait and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Valetec Co.

Valetec Co. has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Valetec Co. shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

Limitation Of Liability

In no event shall Valetec Co., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an and basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Valetec Co. its subsidiaries, affiliates, and its licensors do not warrant that

a) The Service will function uninterrupted, secure or available at any particular time or location

b) Any errors or defects will be corrected

c) The Service is free of viruses or other harmful components

d) The results of using the Service will meet your requirements.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Kuwait, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

User Representations and Warranties:

By using the Service, you expressly represent and warrant that you are at least 18 years old, otherwise capable of entering into binding contracts and legally entitled to enter this Agreement. If you reside in a jurisdiction which restricts the use of the Service because of age, or restricts the ability to enter agreements such as this one due to age, you must abide by such age limits and you must not use the Service. Without limiting the foregoing, the Service is not available to children (persons under the age of 18) or others who are not capable of entering into binding contracts. By using the Service, you represent and warrant that you have the right authority and capacity to enter into this Agreement and to abide by the terms and conditions of this Agreement.

You may be required to register with Valetec in order to access and use certain features of the Service. If you choose to register for the Service, you agree to provide and maintain true, accurate, current and complete information about yourself as prompted by the Service’s registration form. You may only register for a single account per person, and creation of duplicate accounts (including registering the same individual using multiple email accounts) is grounds for immediate termination of all accounts. Registration data and certain other information about you are governed by our Privacy Policy, which can be accessed at Valetec application or at www.valetec.co

You hold a valid driver’s license and are authorized to operate your car and have all proper licenses, approvals and authority to participate in the Services.

You are responsible for removing all items from your vehicle. You should place.

You agree that Valetec Agent shall be permitted to move your vehicle as required for the purpose of providing the Car Valeting Services.

You have the legal right to drive the Car when dropping off the vehicle, and the car is in decent operating condition and meets the industry safety standards and all applicable statutory and state department of motor vehicle requirements for a vehicle of its kind.

You will be solely responsible for the full functionality of your vehicle. If your vehicle fails to function (electrical, mechanical, battery charge or other) in any way while Valetec is in possession of your vehicle, you will be responsible for all storage fees, roadside assistance, alternate transportation and repair of any kind. If your vehicle battery dies while in the possession of Valetec, Valetec may jump-start your battery.

You have the legal right to designate Valetec and any of its agents, employees or representatives as your agent and you delegate actual authority to Valetec to and any of its agents, employees or representatives to operate your vehicle and make decisions on your behalf for the purposes of providing Services offered through the Valetec Application.

You have a valid policy of liability insurance (in coverage amounts consistent with all applicable legal requirements) for the operation of your vehicle to cover any anticipated losses related to your participation in the Services or the operation of your vehicle by Valetec or any of its agents, employees or representatives. You will be solely responsible for any and all liability which results from or is alleged as a result of your operation of the vehicle you use to participate in the Services, including, but not limited to personal injuries, death and property damages. In the event of a motor vehicle accident you will be solely responsible for compliance with the ministry of interior or whomever requests your compliance.

You will obey all applicable laws related to the matters set forth herein (including, but not limited to, vehicle registration and safety regulations), and you will be solely responsible for any violations of such laws (and Valetec expressly disclaims any liability in connection therewith).

You are in proper condition to operate a motor vehicle, and Valetec is not responsible or liable for assessing your state when returning your keys.

You may only use the Services during Valetec’s regular operating hours, which is clearly listed on each Valetec station icon in Valetec application.

If you could not retrieve your car within the working hours of the service, Valetec reserves the right to store your vehicle overnight at a location of Valetec choosing and at your expense

Cancellation of the Services at any time may be subject to a cancellation fee, in Valetec’s sole discretion.

You are responsible for all charges incurred in connection with your use of the Services following the release of the car to your possession (including, but not limited to, fuel charges, tolls, traffic and safety violation penalties, towing expenses, parking tickets, additional parking charges, cleaning fees, etc.).

Valetec reserves the right to adjust your vehicle settings (including, but not limited to, seat and mirror adjustments) to account for safe operation of the vehicle.

You are responsible for all costs associated with normal wear and tear on your vehicle (including, but not limited to, interior or mechanical wear and tear and cleaning). Valetec shall have no liability or responsibility for trash, debris or other mess’s left by passengers or you while providing the Services (including, but not limited to you or your passengers getting sick in the vehicle).

Valetec is not responsible for flat tires, or windshield cracks, which occur in the ordinary course of driving and are not otherwise caused by a collision where Valetec is at fault.

Valetec is not responsible for parking citations received including but not limited to citations that result from the customer’s chosen drop-off location.

For retrieving the car, Valetec reserves the right to return the car back to a parking if you are not present at the requested location within 10 minutes of your scheduled retrieve time.

Valetec is not responsible for false GPS location you confirm your desired location and valetec attendant will meet the selected location. Location data provided by the application is for basic location purposes only and is not intended to be relied upon in situations where the GPS is inaccurate or incomplete location data may lead to death, personal injury, property or environmental damage. Neither Valetec, nor any of its content providers, guarantees the availability, accuracy, completeness, reliability, or timeliness of location data displayed by the Services.

Your vehicle documents such as the car registration and car insurance should be available and not expired

It is your responsibility to ensure that all contents and valuables are removed from the vehicle prior to your departure, Valetec is not responsible for any belongings that are kept inside your car while you request the service.

Valetec shall not be liable for any indirect, special or consequential loss.

Nothing in these Conditions shall operate to limit or exclude the liability of Valetec for:

Death or personal injury resulting from Valetec negligence (including the negligence of Valetec agents, employees or the Agent(b) fraud, fraudulent misrepresentation or fraudulent concealment of Valetec, its agents, employees, or the Agent or Any matter which cannot lawfully be excluded or limited.

Valetec expressly disclaims liability for any events or damage that may occur to or in connection with you or your vehicle after the Services have been completed.

We do not procure insurance for, nor are we responsible for any damage to, loss of or theft of, personal belongings or intellectual property left in the car. These include tapes, records, discs or other similar audio visual or data electronic devices, any speed measuring equipment within the vehicle or any other accessories of any kind. It is your responsibility to ensure that you remove any personal belongings from the car before and after each Valetec service arranged through Valetec.

Modifications to Service: Valetec reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Valetec will not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

INSURANCE AND DAMAGE TO PROPERTY

Valetec doesn’t procure insurance while Valetec is parking or returning your vehicle in connection with the Services. We do not procure insurance for, nor are we responsible for any damage to, loss of or theft of, personal belongings or intellectual property left in the car. These include tapes, records, discs or other similar audio visual or data electronic devices, any speed measuring equipment within the vehicle or any other accessories of any kind. It is your responsibility to ensure that you remove any personal belongings from the car before and after each Valetec service arranged through Valetec.

Compliance with Local Laws:

You agree to comply with all state and local laws and regulations while using the Services, including, but not limited to, all driving, traffic and pedestrian related laws and regulations.

THIRD PARTY WEBSITES

The Service may provide, or third parties may provide, links or other access to other sites and resources on the Internet. Valetec has no control over such sites and resources and Valetec is not responsible for and does not endorse such sites and resources. You further acknowledge and agree that Valetec will not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any content, events, goods or services available on or through any such site or resource. Any dealings you have with third parties found while using the Service are between you and the third party, and you agree that Valetec is not liable for any loss or claim that you may have against any such third party.

SOCIAL NETWORKING SERVICES

The Services may permit you to enable or log in to the Service via various online third party services, such as social media and social networking services like instgram. By logging in or directly integrating these Social Networking Services into the Service, we make your online experiences richer and more personalized. To take advantage of this feature and capabilities, we may ask you to authenticate, register for or log into Social Networking Services on the websites of their respective providers. As part of such integration, the Social Networking Services will provide us with access to certain information that you have provided to such Social Networking Services, and we will use, store and disclose such information in accordance with our Privacy Policy. For more information about the implications of activating these Social Networking Services and Valetec’s use, storage and disclosure of information related to you and your use of such services within Valetec (including your friend lists and the like), please see our Privacy Policy. However, please remember that the manner in which Social Networking Services use, store and disclose your information is governed solely by the policies of such third parties, and Valetec shall have no liability or responsibility for the privacy practices or other actions of any third party site or service that may be enabled within the Service.

In addition, Valetec is not responsible for the accuracy, availability or reliability of any information, content, goods, data, opinions, advice or statements made available in connection with Social Networking Services. As such, Valetec is not liable for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Social Networking Services. Valetec enables these features merely as a convenience and the integration or inclusion of such features does not imply an endorsement or recommendation.

INDEMNITY AND RELEASE

You agree to release, indemnify and hold Valetec and its affiliates and their officers, employees, directors and agent harmless from any and all losses, damages, expenses, including reasonable attorneys’ fees, rights, claims, actions of any kind and injury (including death) arising out of or relating to your use of the Services, any User Content, the condition of your vehicle, your operation of your vehicle, or your violation of these Terms of Service or your violation of any rights of another.
